The Bazooka Companies, LLC (“Bazooka, “we,” or “us”) and its affiliated entities respect the privacy rights of our users, particularly those under 13, and understand the importance of protecting these rights. Before you use the website where this Privacy Notice is posted (the “Site”), please read the following Privacy Notice carefully to understand how your personal information will be treated as you make full use of our offerings at this Site.

At Bazooka, our children’s privacy practices are guided by the United States’ Children’s Online Privacy Protection Act of 1998, as well as data privacy laws throughout the United States. Younger visitors should always check with their parents or guardians before entering information on any website or mobile application, and we encourage families to discuss their household guidelines regarding the online sharing of personal information.

As used in this Privacy Notice, the term “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

HOW WE COLLECT INFORMATION AND WHAT WE COLLECT

Information You Voluntarily Provide:

We collect personal information from visitors when they contact us with questions and comments or exercise their rights with regard to their personal information. For example, we may collect:

  • Identifiers, such as your first and last name, email address, phone number, and mailing address.

Information Collected Automatically:

When visitors access the Site, we automatically collect certain information from their devices, such as:

Some of the information we collect may be considered Sensitive Personal Information under privacy laws, such as the personal information of children under 13 years of age. We use your Sensitive Personal Information only for legitimate business purposes, including to (i) perform services or provide goods reasonably expected by an average person; (ii) detect security incidents; (iii) resist malicious, deceptive or illegal actions; (iv) ensure the physical safety of individuals; (v) for short-term, transient use; (vi) perform or provide internal business services; or (vii) verify or maintain the quality or safety of a service or device. We do not sell your Sensitive Personal Information.

HOW WE USE YOUR INFORMATION

We collect information for the following purposes: provide online games; understand how consumers use our Site; enhance and improve our Site; communicate with you; prevent misuse of the website, theft, or fraud; protect our intellectual property or the rights or property of others, and protect our users, our business, and third parties; perform website analytics and generate statistics about users and usage patterns; and comply with and enforce applicable laws and our policies and terms. If a child contacts us with a question or request, we will use the information solely to respond to the inquiry.

COOKIES AND TRACKING TECHNOLOGY

We use necessary and functional cookies or similar technologies (collectively referred to as “Tracking Technologies”) on the Site. Cookies (which may be HTML files or other technology) are text files that help store user preferences and activity.

Cookie management: You have the ability to accept or decline cookies. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Site.

Browser Signals

Some web browsers have “Do Not Track” or similar features that allow visitors to tell each website they visit that they do not want their activities on that website tracked. There is no uniform standard for implementing and recognizing “Do Not Track” signals. For that reason, at present, our websites do not respond to “Do Not Track” signals.

DISCLOSURE TO THIRD PARTIES

In the past 12 months, we may have disclosed your information to third parties for the limited purposes described below. Parents of children under the age of 13 have the option of consenting to the collection and use of their child’s personal information without consenting to the disclosure of that information to certain third parties. 

Legal Compliance and Safety: We may access, preserve, and/or disclose the information we collect and/or content you provide to us to a law enforcement agency or other third parties if required to do so by law or with a good faith belief that such access, preservation, or disclosure is reasonably necessary to: (i) comply with laws or legal process; (ii) limit our legal liability; (iii) enforce the Site’s Terms of Service; (iv) respond to claims that the content violates the rights of third parties; (v) respond to your requests for customer service; or (vi) protect the rights, property, or personal safety of the owners of the Site, any user of the Site, a third party or the general public.

Service Providers: Information collected through the Site may be transferred or disclosed to third-party providers engaged by us to handle and deliver certain activities, such as technical and processing functions, maintaining data integrity and security, programming operations, user services or technology services. We may provide these third parties information collected as needed to perform their functions, but they are prohibited from using it for other purposes and are required to maintain the confidentiality of such information.

Business Transfer: In the event that assets relating to the Site are transferred or sold to another entity as a result of, for example, a corporate sale, merger, consolidation, asset sale, or in the unlikely event of bankruptcy, information collected at the Site may be transferred to the acquiring company.

With Your Consent: We may otherwise disclose your information pursuant to your consent. We will disclose a child’s personal information to third parties only with the consent of such child’s parent or guardian.

SECURITY, STORAGE AND RETENTION OF INFORMATION

We maintain reasonable administrative, technical, and physical measures to help ensure that information collected is secure. However, as with most Internet sites and services, no security measures are perfect or impenetrable, despite our efforts. Information collected at the Site will not be stored for longer than is necessary for the purposes described in this Privacy Notice, or to otherwise meet legal, regulatory, tax, accounting, or reporting requirements.

CHILD PRIVACY RIGHTS

Accessing, Updating, and Correcting Information: You have the right to access, delete, update and correct factual inaccuracies in your or your child’s personal information that we collect online at the Site, subject to certain exceptions. To do so, you may e-mail us at privacypolicy@bazooka-inc.com. We will take steps to verify the identity of anyone requesting personal information about a child and to ensure that the person is in fact the child’s parent or legal guardian. If you are a minor under 18, you may submit a request to remove content or information you posted at the Site, if any, at the same e-mail address. We will use reasonable efforts to remove or update content or information in compliance with your request and the prevailing law.

CARU SAFE HARBOR NOTICE

This Privacy Notice and the CARU icon shown on our website confirms that Bazooka Companies, LLC is a valid licensee and participating member in the CARU COPPA Safe Harbor Program (“CARU COPPA Safe Harbor”). To protect your privacy, we have voluntarily undertaken this privacy initiative. CARU has reviewed and certified that we meet established online information collection and use practices on all Bazooka Companies, LLC properties where this Privacy Notice is posted. 

As part of the CARU COPPA Safe Harbor, we are subject to audits and frequent monitoring of our website and other enforcement and accountability mechanisms administered independently by CARU.

Residents of California have certain rights with respect to their personal information (sometimes referred to as personal data) under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act.

We do not sell or share personal information as defined by California law.

Shine the Light

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties to which we disclosed personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below. Please note that Bazooka does not disclose to third parties for direct marketing purposes any information obtained from the Site.

Your California Rights

If you are a California resident, you may have the following rights with respect to the personal information we process about you:

  • Right to Know. You may have the right to request information about the categories of personal information we have collected about you, the categories of sources from which we collected the personal information, the purposes for collecting, the categories of third parties to whom we have disclosed your personal information, and the specific pieces of personal information we have collected about you.
  • Right to Delete. You may have the right to request that we delete personal information that we have collected from you.
  • Right to Correct. You may have the right to request that we correct inaccurate personal information that we maintain about you.
  • Right to Non-Discrimination. Should you choose to exercise any of these rights, we will not discriminate against you in any way. If you exercise certain rights, understand certain features of our website and mobile applications may be unavailable to you.

Exercising Your California Rights

To exercise any of the state rights above, please submit a request to us by either by calling us at 1-844-583-1878, or by emailing us at privacypolicy@bazooka-inc.com.

You can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable law.

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided to us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

ADDITIONAL STATE PRIVACY DISCLOSURES

These Privacy Disclosures supplement the information contained in the Privacy Notice. These Disclosures apply only to residents of Nebraska and Texas.

Consumer Privacy Rights

You may have the following rights, subject to any applicable exemptions or limitations:

  • Right to Access. You have the right to confirm whether we are processing your personal information and to access such personal information.
  • Right to Correct. You have the right to request that we correct inaccurate personal information that we maintain about you.
  • Right to Delete. You have the right to request that we delete your personal information under specific circumstances.
  • Right to Data Portability. You have the right to request a copy of your personal information in an accessible format.
  • Right to Equal Service. If you choose to exercise any of these rights, we will not discriminate against you in any way. If you exercise certain rights, understand that you may be unable to use or access certain features of our websites, services, or properties.

Submitting a Privacy Rights Request
